Audivision Terms of Use

The short version

  • Audivision reads text aloud from documents, books and the camera. It is not always accurate. Do not rely on it where a mistake could harm you, and it is not a medical device.
  • You need to sign in with Apple to use it. Some features are free; Premium is an annual subscription that renews automatically, or a one-time lifetime purchase.
  • Apple takes payment. Cancel the subscription in your Apple Account settings, at least 24 hours before it renews. Refunds are handled by Apple.
  • The documents you read stay on your phone, and you are responsible for having the right to use them.
  • Our liability is limited, as set out in section 14.
  • Indian law applies to these terms.

This summary is for convenience. The full terms below are what you agree to.

1. Who we are, and this agreement

Audivision (“Audivision” or “the app”), including its Apple Watch app and widgets, is published and operated by Audirivision Technologies Private Limited, a company incorporated in India, with its registered office at VO-505, 10th Floor, NESCO Tower 4, C Wing, Nesco IT Park, Western Express Highway, Goregaon (East), Mumbai 400063 (“we”, “us”, “our”).

These terms are a legally binding agreement between you and us. You accept them when you sign in to the app, where the sign-in screen says that by signing in you agree to these terms and to our Privacy Policy, which forms part of them. These terms build on Apple’s Licensed Application End User License Agreement (the “Apple Standard EULA”): it applies to you as well, and where these terms say more, or differ, these terms apply, as far as Apple’s rules allow.

2. Who accepts these terms

  1. Adults accept for themselves. If you are 18 or over, you accept these terms yourself. Someone may help you, for example by reading them aloud or operating the phone, but the decision to accept is yours.
  2. Accepting for another adult. You may accept these terms for another adult only if you have legal authority to act for them in this matter, for example as their court-appointed guardian, or under a power of attorney that covers it.
  3. Children. If the person who will use Audivision is under 18, a parent or lawful guardian must accept these terms for them, and is responsible for their use of the app.

3. What Audivision does

Audivision recognises text in what your camera sees, in scanned pages, and in documents, e-books, images and web pages you open in it, and reads that text aloud using on-device speech synthesis or the voices built into iOS. It also offers a library of public-domain books, a reader with highlights, notes and bookmarks, reading statistics, and an Apple Watch app that controls narration on your iPhone.

4. Audivision is an aid, and it can be wrong

  1. Not always accurate. Text recognition can miss, misread or reorder text, especially in poor light, at an angle, with unusual fonts, handwriting, tables or complex layouts. Language detection can be wrong. Speech can mispronounce words, numbers and abbreviations. Check anything important with another source or another person.
  2. Not for situations where you could be harmed. Audivision should not be used in situations where you could be harmed or injured, nor as a primary means of navigation, nor as a basis for financial or monetary decisions. Do not rely on it alone to read medicine labels and dosages, expiry dates, safety warnings, legal documents or amounts of money.
  3. Not a medical device. Audivision is not intended for use in the detection, diagnosis, monitoring, management or treatment of any medical condition or disease.
  4. At your own risk. You use Audivision at your own risk, and you remain responsible for decisions you make while using it.

5. Your account

You sign in with your Apple Account. Keep your Apple Account secure: anything done through it in Audivision is treated as done by you. You can delete your Audivision account at any time in the app, under menu › About › Account details › Delete my account. Deletion becomes permanent after 30 days, and signing in again before then cancels it, as the Privacy Policy explains.

6. Premium, subscriptions and purchases

  1. Free and Premium. Some features of Audivision are free, with limits. Premium removes those limits. The app shows what is included and the current price before you buy. We may change what is free and what is Premium; if we do, we will not take away a Premium benefit you have already paid for during the period you paid for.
  2. Two ways to buy Premium: an annual subscription, which renews automatically, or a lifetime one-time purchase, which does not expire and is not billed again. “Lifetime” means for as long as we offer the app and it runs on your devices.
  3. Apple takes payment. All purchases are made through the App Store and charged to your Apple Account when you confirm the purchase. Apple’s terms for the App Store apply to the payment. We never see your payment details.
  4. Automatic renewal. The annual subscription renews automatically every year unless it is cancelled at least 24 hours before the end of the current period. The renewal is charged to your Apple Account within the 24 hours before the current period ends. If the price changes, Apple will tell you in advance and, where Apple’s rules require it, ask for your agreement.
  5. Cancelling. You can manage or cancel your subscription at any time in your Apple Account settings (on iPhone: Settings › your name › Subscriptions). Cancelling stops the next renewal; Premium stays on until the end of the period you have paid for. Deleting the app, or deleting your Audivision account, does not cancel a subscription.
  6. Refunds. Payments are made to Apple, so we cannot issue refunds ourselves. You can ask Apple for a refund at reportaproblem.apple.com, and Apple decides under its own policies. This does not affect any right to a refund you have under consumer law.
  7. Restoring. Purchases belong to your Apple Account. On a new phone, or after reinstalling, open menu › Premium › Restore purchase while signed in to the same Apple Account.

7. Your documents and content

The documents, images, e-books and web pages you open in Audivision are yours or are provided by others, not by us. They are processed and stored on your phone and are not uploaded to us. You are responsible for having the right to open, convert, read aloud and export them, and for respecting copyright and any other rights in them. Making a copy for your own accessible reading may be allowed by the law where you live; sharing that copy with others may not be.

8. The built-in books

The Books library offers literary works that are in the public domain. We have prepared them for reading in the app and removed third-party branding and licence text that does not apply to them. Whether a work is in the public domain can differ from country to country. The books are offered for personal reading, and you are responsible for checking that a work is free to use where you live before you use it outside the app. Our formatting, selection, collections, cover designs and descriptions belong to us.

9. Open-source components

Audivision includes open-source software. Each component is licensed to you under its own licence, and nothing in these terms limits the rights those licences give you. The components and their licence texts are listed in the app under menu › About › Open-source licenses.

10. Your responsibilities

When you use Audivision, you agree that you will not:

  1. use it in a way that breaks the law, infringes anyone’s rights, or puts you or other people at risk;
  2. copy, modify, decompile, reverse-engineer or try to extract the source code, models, voices, keys or protected content of the app, or get around its content protection, except where the law expressly allows it;
  3. interfere with, overload or try to gain unauthorised access to our servers or services, or use automated means to download the built-in books in bulk; or
  4. without our written permission, resell, rent or sublicense the app or its content, or use it to provide a commercial service to others.

Section 10(d) does not restrict using Audivision for your own accessibility needs, including at work, or being helped to use it by a family member, carer or support worker, whether paid or unpaid.

11. Our intellectual property and your licence

The app, its design, models, voices and protected content, the Audivision name and logo, and all related software and technology belong to us or our licensors and are protected by law. We give you a personal, non-exclusive, non-transferable and revocable licence to install and use the app on Apple devices you own or control, as allowed by the App Store Usage Rules and these terms. We keep all other rights.

12. Apple

  1. These terms are between you and us, not Apple. We, not Apple, are solely responsible for the app and its content.
  2. Apple has no obligation to provide any maintenance or support for the app. For support, see our Support page.
  3. If the app fails to conform to any warranty that applies, you may notify Apple, and Apple will refund the purchase price for the app (if any). To the maximum extent the law allows, Apple has no other warranty obligation for the app.
  4. We, not Apple, are responsible for addressing any claims by you or a third party relating to the app or your use of it, including product liability claims, claims that the app fails to conform to a legal or regulatory requirement, and claims under consumer protection, privacy or similar laws.
  5. If a third party claims that the app or your use of it infringes their intellectual property rights, we, not Apple, are responsible for the investigation, defence, settlement and discharge of that claim.
  6. You confirm that you are not located in a country subject to a United States Government embargo or designated as a “terrorist supporting” country, and that you are not listed on any United States Government list of prohibited or restricted parties.
  7. You must comply with any third-party terms that apply when you use the app, for example your mobile network’s terms.
  8. Apple and its subsidiaries are third-party beneficiaries of these terms and, once you accept them, may enforce them against you.

13. No warranty

To the maximum extent permitted by law, the app, the built-in books and everything the app reads, recognises or says are provided “as is” and “as available”, without any warranty or condition of any kind, whether express or implied. This includes any warranty that the app will be accurate, reliable, complete, uninterrupted, error-free or fit for any particular purpose, or that it will work on your device or without a connection.

14. Limitation of our liability

  1. To the maximum extent permitted by law, we, and our directors, officers, employees and consultants, will not be liable to you for any loss, injury or damage arising out of or in connection with your use of, reliance on, or inability to use the app, including text that was misread, missed or mispronounced, or the loss of documents or data stored on your device.
  2. We will not in any case be liable for any indirect, incidental, special or consequential loss, or for any loss of data, profit, opportunity or goodwill.
  3. Where we are liable to you despite the above, our total liability for all claims relating to the app will not exceed the greater of the amount you paid for Premium in the 12 months before the claim and one thousand Indian rupees (₹1,000).
  4. What these limits do not affect. Nothing in these terms excludes or limits any liability that cannot be excluded or limited under applicable law, or any rights you have as a consumer that cannot be waived by contract.

15. Governing law and disputes

These terms are governed by the laws of India. If you have a concern, please contact us first (section 17), and we will try to resolve it with you. Subject to any rights you have under consumer protection law to bring a complaint elsewhere, the courts at Mumbai, Maharashtra have exclusive jurisdiction over any dispute arising out of or in connection with these terms or the app.

16. Stopping, suspension and changes to these terms

  1. You can stop using Audivision at any time, and delete your account in the app. If you have a subscription, cancel it with Apple as well.
  2. We may suspend or close the account of anyone who breaches these terms or misuses the app. We may change, add or withdraw features, or stop offering the app; if we stop offering it, we will give reasonable notice where we can.
  3. We may update these terms. We will change the “Last updated” date above, and if a change materially affects your rights, we will tell you in the app before it takes effect. If you do not accept a change, please stop using the app and cancel any subscription.
  4. Sections 4, 7, 11 and 13 to 15 continue to apply after you stop using the app.

18. General

  1. Whole agreement. These terms, the Privacy Policy and the Apple Standard EULA are the whole agreement between you and us about the app.
  2. Severability. If a court finds any part of these terms unenforceable, the rest continues to apply, and the unenforceable part applies to the extent the law allows.
  3. No waiver. If we do not enforce a term straight away, we can still enforce it later.
  4. Transfer. We may transfer our rights and obligations under these terms to another organisation, for example if our business is sold. This will not reduce your rights. You may not transfer your rights under these terms.
  5. Language. Where we provide these terms in languages other than English, the translations are for convenience. If they differ, the English version applies.
